Property Deal Check

Terms & Conditions

These terms apply to the BrickMetrics Pro Property Deal Check service. Please read them before making payment.

1. Who provides the service

Service provider: Martin Smith, trading as BrickMetrics Pro for the Property Deal Check service.

Email: martin@brickmetricspro.co.uk

Website: www.brickmetricspro.co.uk

Paid instructions: Any additional business/contact information required for a paid instruction will be provided before payment is requested.

2. What the Deal Check is

The Property Deal Check is an independent property-investment feasibility review based on information available at the time of the review. Depending on the property and information available, it may include:

  • a personal review of the property and key assumptions;
  • comparable evidence and an indicative working GDV;
  • a refurbishment allowance;
  • buying and funding cost assumptions;
  • cash required, projected profit, ROI and other relevant metrics;
  • key risks, uncertainties and points for further investigation;
  • a BrickMetrics Pro Deal Pack; and
  • a 15-minute review call.

3. What the Deal Check is not

The Deal Check is not a RICS valuation, building survey, structural survey, legal opinion, conveyancing advice, tax advice, planning advice, mortgage recommendation or regulated financial advice. It does not guarantee that a property is suitable to buy or that any projected value, cost, profit, rent, refinance amount or return will be achieved.

You remain responsible for deciding whether to proceed and for obtaining any professional advice or reports appropriate to the property before committing to a purchase.

4. Enquiries and when a contract starts

Submitting the website enquiry form does not create a contract and no payment is taken through that form.

I will first review the enquiry and confirm whether I am able to take the Deal Check on. Unless we agree otherwise in writing, a contract for the Deal Check starts when I have confirmed acceptance of the work and your payment has been received.

5. Price and payment

The current launch price is £79 per property. If a property requires work outside the normal Deal Check scope, I will explain this and agree any different price with you before payment.

Payment is normally made by bank transfer using the details supplied privately after the enquiry has been accepted. Work will not normally begin until cleared payment has been received.

6. Information you provide

You are responsible for providing accurate information and for telling me about any material facts you already know that may affect the review. Where information is missing, I may use clearly stated working assumptions.

Please do not send passwords, full bank details, identity documents or other unnecessary sensitive personal information through the Deal Check enquiry form.

7. Data, estimates and third-party information

The review may use publicly available property information, user-supplied information and third-party data sources. Property records, listings, sold-price information and other third-party data can contain omissions, delays or errors.

GDV, refurbishment, finance, rent, costs and returns are estimates or working assumptions unless expressly stated otherwise. Material figures should be independently checked before you rely on them.

8. Turnaround

I aim to complete a standard Deal Check within 2 working days after payment has been received and I have the information needed to begin. This is a target rather than a guaranteed deadline.

If the property is unusually complex, information is missing, or circumstances outside my reasonable control cause a delay, I will let you know as soon as reasonably practical.

9. The review call

The £79 Deal Check includes one review call of up to 15 minutes. Its purpose is to explain the findings and answer reasonable questions about the completed Deal Check. Substantial additional research or consultancy outside the original scope may require a separate agreement.

10. Cancellation rights for consumers

If you enter into the contract as a consumer, you will normally have 14 days from the day the service contract is entered into to cancel without giving a reason.

Because a Deal Check is normally intended to be completed quickly, you may ask me to start the service during that 14-day cancellation period. If you make that express request and then cancel before the Deal Check has been fully completed, you may be required to pay an amount proportionate to the work already provided up to the time you cancel.

If you expressly ask me to start during the cancellation period and acknowledge that your cancellation right will be lost once the service has been fully performed, that right will end once the Deal Check has been completed in full.

If you are contracting wholly or mainly for purposes relating to your trade, business, craft or profession, statutory consumer cancellation rights may not apply.

How to cancel

To cancel, email martin@brickmetricspro.co.uk with a clear statement that you wish to cancel. You can also use the model form below, although you do not have to use it.

11. Refunds

Where a valid cancellation is made before work starts, any payment received for the Deal Check will be refunded. Where you expressly requested that work begin during a consumer cancellation period and cancel after work has started but before completion, any refund may be reduced by a proportionate amount for the service already provided, where the law permits.

12. Decisions, outcomes and responsibility

Property investment involves risk. Market values, finance costs, refurbishment costs, sale times, rents, planning outcomes and other factors can change. The Deal Check is intended to help you assess an opportunity, not to make the purchase decision for you.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, and nothing in these terms affects your statutory rights.

13. Complaints

If you are unhappy with the service, please email martin@brickmetricspro.co.uk with the property address and details of the issue. I will aim to acknowledge the complaint promptly and deal with it fairly.

14. Personal information

Personal information supplied for the Deal Check will be used to handle the enquiry, provide the service, communicate with you and maintain reasonable business records. Form submissions are currently processed using Formspree as a service provider.

A separate privacy notice should be provided for fuller information about personal-data handling.

15. Changes to these terms

I may update these terms from time to time. The terms that apply to your Deal Check will be the version provided or made available to you before the contract is entered into.

16. Governing law

These terms are governed by the law of England and Wales. If you are a consumer, this does not remove any mandatory legal protections or rights you have under the law that applies to you.
